1. Acceptance of Terms

By accessing or using aumenu.ca or any Au Menu services, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms, you must not use the services.

These Terms constitute a legally binding agreement between you and 9312-9856 Quebec Inc., operating as Au Menu.

2. Eligibility

You must be at least 18 years old to create an account and make bookings through Au Menu.

By creating an account, you confirm that you meet this requirement.

You may book on behalf of minors attending under your supervision.

3. Account Registration

Users must provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

You agree to notify Au Menu immediately of any unauthorized use of your account.

4. Bookings and Payments

4.1 Advance Payment Required

All reservations require full payment in advance.

Reservations are not confirmed until payment has been successfully processed.

4.2 Pricing

All prices are listed in Canadian dollars and exclude applicable taxes unless otherwise stated.

Prices and availability are subject to change without notice.

4.3 Payment Processing

Payments are processed securely through Shopify Payments.

Au Menu does not store full payment card information.

By submitting payment, you authorize Au Menu to charge the selected payment method.

4.4 Event Capacity

Dining experiences are subject to limited seating availability.

Once capacity is reached, reservations may close automatically.

5. Cancellation and Refund Policy

5.1 Guest Cancellations

All bookings are final and non-refundable.

No refunds will be issued for cancellations, no-shows, late arrivals, or changes of mind.

However, in limited exceptional circumstances, Au Menu may, at its sole discretion, offer a credit, transfer, or accommodation.

Any exception granted does not create an ongoing obligation or precedent.

5.2 Restaurant Cancellations or Significant Changes

If a restaurant partner cancels an event or makes a significant modification to the confirmed experience, Au Menu may issue a refund, credit, or alternative accommodation at its discretion.

5.3 Force Majeure

Au Menu shall not be liable for delays, disruptions, or cancellations caused by circumstances beyond its reasonable control, including:

  • Natural disasters

  • Government actions

  • Public health emergencies

  • Strikes

  • Utility failures

  • Severe weather

  • Acts of terrorism

  • Other force majeure events

6. Chargebacks and Payment Disputes

By completing a booking, you agree not to improperly initiate chargebacks or payment disputes for valid charges related to confirmed reservations.

Au Menu reserves the right to suspend or terminate accounts associated with fraudulent or abusive chargeback activity.

Reservation records, communications, and attendance confirmations may be used as evidence in responding to payment disputes.

7. Guest Arrival and Timing

Guests are responsible for arriving on time.

Restaurants may begin service promptly at the scheduled time to preserve the experience for all guests.

Late arrivals may result in missed courses, modified service, or denied entry at the discretion of the restaurant partner, without compensation.

No refunds or credits will be issued for late arrivals.

8. Dining Experience and Restaurant Liability

8.1 Platform Role

Au Menu acts solely as a technology, booking, marketing, and payment facilitation platform connecting guests with independent restaurant partners.

Au Menu is not a restaurant operator and does not prepare, serve, supervise, or control food or beverages provided by restaurants.

8.2 Restaurant Responsibility

Restaurants are solely responsible for:

  • Food preparation

  • Food safety

  • Alcohol service

  • Health and sanitation compliance

  • Licensing compliance

  • Staffing and service

  • Overall dining experience

8.3 Dietary Restrictions and Allergies

While Au Menu may collect dietary restrictions and forward them to restaurants as a courtesy, Au Menu makes no guarantee that accommodations will be possible.

Guests with serious allergies are strongly encouraged to contact restaurants directly before attending.

Au Menu disclaims all liability relating to allergic reactions, illness, injury, or damages arising from food or beverages consumed during an event.

8.4 Alcohol Consumption

Certain dining experiences may include alcoholic beverages.

Guests are solely responsible for consuming alcohol responsibly and complying with applicable laws.

Au Menu assumes no responsibility for damages, injuries, losses, or legal consequences arising directly or indirectly from alcohol consumption.

Restaurant partners remain solely responsible for liquor licensing compliance.

9. Accessibility

Accessibility accommodations vary by restaurant location.

Guests requiring accessibility accommodations are encouraged to contact the restaurant directly prior to booking.

Au Menu does not guarantee that all locations will accommodate all accessibility requirements.

10. Event Photography and Media

Au Menu or restaurant partners may photograph or record portions of events for marketing or promotional purposes.

By attending an event, you acknowledge that you may appear incidentally in photographs or videos.

Guests who do not wish to appear should notify Au Menu or the restaurant prior to the event.

11. Guest Conduct

Guests are expected to behave respectfully.

Au Menu and restaurant partners reserve the right to refuse service or remove guests engaging in disruptive, abusive, dangerous, intoxicated, or inappropriate behaviour.

No refund will be provided in such cases.

12. Reservation Transfers

Reservations may not be resold or transferred for commercial purposes.

Personal reservation transfers may be permitted if Au Menu is notified prior to the event.

The original purchaser remains responsible for compliance with these Terms.

13. Suspension or Termination

Au Menu reserves the right to suspend, restrict, or terminate access to the platform for:

  • Violations of these Terms

  • Fraudulent activity

  • Abusive behaviour

  • Misuse of the platform

  • Activity harmful to Au Menu, restaurants, or users

14. Intellectual Property

All website content, branding, logos, graphics, software, text, and related materials are the property of Au Menu or their respective owners and are protected by applicable intellectual property laws.

Restaurant names, trademarks, menus, and related branding remain the property of their respective owners.

Users may not reproduce or commercially exploit any content without permission.

15. User Reviews

Guests may be invited to submit reviews.

By submitting a review, you grant Au Menu the right to display, edit, moderate, or remove content at its discretion.

Reviews must reflect genuine experiences and may not contain defamatory, abusive, fraudulent, or misleading content.

16. Electronic Communications

By creating an account or using the services, you consent to receiving communications electronically, including:

  • Booking confirmations

  • Event reminders

  • Customer support messages

  • Promotional communications

  • Legal notices

Electronic communications satisfy legal requirements that communications be in writing.

17. Limitation of Liability

To the fullest extent permitted by law, Au Menu and its affiliates, directors, employees, contractors, and partners shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Incidental damages

  • Lost profits

  • Personal injury

  • Property damage

  • Food-related illness

  • Service dissatisfaction

  • Third-party actions

In no event shall Au Menu’s total liability exceed the amount paid for the reservation giving rise to the claim.

18. Indemnification

You agree to indemnify and hold harmless Au Menu and its affiliates from any claims, damages, liabilities, expenses, or legal fees arising from:

  • Your use of the platform

  • Your attendance at events

  • Your violation of these Terms

  • Your conduct toward restaurants or other guests

19. Governing Law

These Terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Quebec.

20. Language

The parties acknowledge that they have requested that these Terms and related documents be drafted in the English language.

21. Changes to These Terms

Au Menu reserves the right to modify these Terms at any time.

Updated versions will be posted on the website with a revised effective date.

Continued use of the platform constitutes acceptance of the revised Terms.
